The notion of reasonable interpretation of legal texts, as opposed to the absurd or unacceptable interpretation, is presupposed in different legal theories as the fundamental basis of legal rationality and as a clear limitation to chaotic behaviour by courts. This article argues that the ever-present notion of reasonability is not a useful descriptive tool for understanding legal practices or how legal institutions work. The article builds on radical legal realism perspective in order to develop two arguments supporting this claim. First, (...) it argues that, from an empirical point of view, the complexity of contemporary law and its multiple layers of normativity do not allow for the description of what a reasonable interpretation is, since no coherent universal interpretative community can be envisioned. Second, from a conceptual point of view, it argues that describing the references interpreters make to reasonability as references to a semantic object—that is, to some kind of universal “reasonableness”, a model of reasonable behaviour or rationality—is not a reliable way of understanding judicial practice in a certain legal context. This is the case because, as an internal justification discourse, the appeal to reasonability by the interpreter has no bearing on truth or correctness. Nothing prevents courts from cherry-picking a meaning for reasonability in each case, using it as the justification to solve similar cases in different, sometimes contradictory ways. In short, the concept of reasonability cannot be taken, in itself, as an instrument of legal analysis. As a prescriptive discourse, it can merely be one of the objects legal science intends to observe and explain. Its discursive functions—not its semantic references—, as part of a strategy to convince and to justify, are the only observable elements that can sustain a coherent falsifiable description by legal science. Current thinking and research on consciousness and the brain.

Fifteen of these essays by one of the leading authorities on Renaissance Platonism explore the complex philosophical, hermeneutical, and mythological issues addressed by the Florentine, Marsilio Ficino (1433-99). Ficino was the pre-eminent Platonist of his time and a distinguished philosopher, scholar and magus who had an enormous influence on the intellectual and cultural life of two and a half centuries, and who is one of the most important witnesses to the preoccupations of his age, above all to its fascination with (...) ancient poetry and philosophy and their uneasy accommodation as an ancient "theology" with Christianity. Two further essays treat of cognate themes taken up by Ficino's younger friend and rival, the dazzling prince of Concordia, Giovanni Pico della Mirandola (1463-94), who was fascinated by Platonism in his youth but also by other philosophical legacies from the past, including Cabala and the Scholastic Aristotelianism of the Middle Ages. How does talk work, and can we engage the public in a dialogue about the scientific study of talk? This article presents a history, critical evaluation and empirical illustration of the public science of talk. We chart the public ethos of conversation analysis that treats talk as an inherently public phenomenon and its transcribed recordings as public data. We examine the inherent contradictions that conversation analysis is simultaneously obscure yet highly cited; it studies an object that people understand intuitively, yet (...) routinely produces counter-intuitive findings about talk. We describe a novel methodology for engaging the public in a science exhibition event and show how our ‘conversational rollercoaster’ used live recording, transcription and public-led analysis to address the challenge of demonstrating how talk can become an informative object of scientific research. We conclude by encouraging researchers not only to engage in a public dialogue but also to find ways to actively engage people in taking a scientific approach to talk as a pervasive, structural feature of their everyday lives. This paper explores a remarkable convergence of ideas and evidence, previously presented in separate places by its authors. That convergence has now become so persuasive that we believe we are working within substantially the same broad framework. Taylor's mathematical papers on neuronal systems involved in consciousness dovetail well with work by Newman and Baars on the thalamocortical system, suggesting a brain mechanism much like the global workspace architecture developed by Baars (see references below). This architecture is relational, in the sense (...) that it continuously mediates the interaction of input with memory. While our approaches overlap in a number of ways, each of us tends to focus on different areas of detail. What is most striking, and we believe significant, is the extent of consensus, which we believe to be consistent with other contemporary approaches by Weiskrantz, Gray, Crick and Koch, Edelman, Gazzaniga, Newell and colleagues, Posner, Baddeley, and a number of others. We suggest that cognitive neuroscience is moving toward a shared understanding of consciousness in the brain. (shrink)

Irenaeus, Coleridge and Gadamer all wrote about religion in distinct historical periods, however the work that each produced reflects the anthropological condition of the middle position. Furthermore, each thinker provides an opportunity for self-reflection about the motivations of faith without requiring the individual to abandon their religious belief in order to do so. In this manner they present a productive alternative to the required external views of the social sciences. The individual's position in mid-creation, his moral freedom and his historical (...) contingence all require the acceptance, commitment and trust of faith. Gnosticism, Empiricist thought and the desire to overcome historical contingency all reveal intellectual impatience in riposte to this condition. This intellectual impatience seeks the absolute without the need for faith. For Irenaeus, Coleridge and Gadamer such absolute, logocentric, complete systems end up alienating man from the reality of the incomplete condition that permeates his existence and the faith-requiring mythos that ultimate realities necessitate in order to be communicated. In the paper I offer a brief sketch of one of the sources of utilitarianism. Our biological ancestry is a matter of fact that is not altered by the way we describe ourselves. With philosophical theories it is otherwise. Utilitarianism can be described in ways that make it look as if it is as old as moral philosophy – as J. S. Mill thought it was. For my historical purposes, it is more useful to have an account that brings out (...) what is specific about Benthamism and its descendants. Let us try to make do with the following. First, utilitarianism asserts that the fundamental requirement of morality is that we are to maximize good, for everyone and not just for the agent. This basic principle presupposes that it makes sense to think of aggregating goods to make a total, and of comparing amounts of good thus aggregated. Second, the good to be brought about is located in feelings of pleasure, and the evil to be avoided in feelings of pain. These feelings have inherent value or disvalue regardless of how they are caused to exist and regardless of their own consequences. Third, all moral principles can be derived from the requirement that good be maximized. The principles involved in evaluating agents as well as in giving moral direction to action are nothing but applications of the basic principle. (shrink)

Part I of this two-part paper provided a broad overview of clinical and experimental findings bearing on the neural correlates of conscious processes. It was argued that several neurocognitive models related to: orienting to the outer world, dream sleep, and the integration of sensory-motor representations, converge upon a core ‘conscious system’, dubbed the extended reticular-thalamic activating system . The functions of the ERTAS, which shares extensive projections with the cerebral cortex, are mostly ‘implicit’, in contrast to the explicit representation of (...) conscious content within the neocortex. Part II expands this ERTAS model to encompass: the generation of coherent patterns of EEG activation, the integration of distributed cortical processes into a stream of unified percepts , and selective attention, as well as links between the ERTAS and systems providing the neural substrates for episodic memory and volition. We examine the closure conditions of the probabilistic consequence relation of Hawthorne and Makinson, specifically the outstanding question of completeness in terms of Horn rules, of their proposed (finite) set of rules O. We show that on the contrary no such finite set of Horn rules exists, though we are able to specify an infinite set which is complete.

We give an account of some relationships between the principles of Constant and Atom Exchangeability and various generalizations of the Principle of Instantial Relevance within the framework of Inductive Logic. In particular we demonstrate some surprising and somewhat counterintuitive dependencies of these relationships on ostensibly unimportant parameters, such as the number of predicates in the overlying language.
